Great summer weather in South Dakota delights residents and visitors alike. Roads are busier with people enjoying the state’s natural beauty and spending vacation time at Mount Rushmore and Sturgis. However, police officers throughout the state associate the period running from Memorial Day through Labor Day with something not as pleasant.

June, July and August comprise most of what some authorities call the "100 Deadliest Days of Summer.” This period is notoriously perilous for vehicle drivers and passengers. During 2024, these three months accounted for 50 of the 146 annual traffic fatalities recorded in the state. In response, South Dakota law enforcement agencies have intensified their efforts to combat road behaviors that lead to summertime vehicle collisions, particularly drunk driving.

As part of the summer initiative, sobriety checkpoints will be installed in locations throughout the state. During July, roadblocks are scheduled for 17 different counties. These checkpoints can identify motorists who are operating their vehicle under the influence. However, a possibility exists that overzealous enforcement might lead to unwarranted charges, or the unlawful seizure of evidence, because officers did not adhere to the strict guidelines that govern these stops.

One goal of the campaign is to reduce the incidence of car and truck accidents among young drivers. Teenagers are three times more likely to get into a crash during the summer when school is out. Motorists under the age of 21 can be charged with driving under the influence even if their blood-alcohol concentration is .02 percent. This means that one drink might lead to an arrest.

If you’re caught up in the “100 Deadliest Days” efforts or are accused of drunk driving at any other time of the year, don’t forfeit your legal rights. No matter what the case against you looks like, there might be defenses available that can help you obtain a dismissal, acquittal or reduced charge. However, you need to consult with an experienced DUI defense lawyer to learn what options you have.
